This End User Licence Agreement (“Agreement”) is a legal agreement between you (“User”) and Wellbeing Passport (“Licensor”, “we”, “us”, “our”) governing your use of the Wellbeing Passport mobile application (“Application”).
This Agreement is between you and Wellbeing Passport only, not Apple Inc. Apple is not responsible for the Application or its content.
1. Acknowledgement
This Agreement is concluded between you and Wellbeing Passport only, and not with Apple.
Wellbeing Passport, not Apple, is solely responsible for the Application and its content.
2. Scope of Licence
We grant you a limited, non-exclusive, non-transferable licence to use the Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
Wellbeing Passport reserves the right to suspend or terminate access for misuse or breach of this Agreement.
3. Maintenance and Support
Wellbeing Passport is responsible for providing maintenance and support for the Application.
Apple has no obligation to provide any maintenance or support services.
4. Warranty
The Application is provided “as is” and “as available”, without warranties of any kind, except as required by law.
To the maximum extent permitted by law, Wellbeing Passport disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
If the Application fails to conform to any applicable warranty, you may notify Apple.
Apple may refund the purchase price (if any), but Apple has no further warranty obligation.
5. Product Claims
Wellbeing Passport, not Apple, is responsible for addressing any claims relating to the Application, including but not limited to:
- Product liability claims
- Claims that the Application does not comply with legal or regulatory requirements
- Consumer protection claims
6. Intellectual Property Rights
In the event of any third-party claim that the Application infringes intellectual property rights, Wellbeing Passport, not Apple, is solely responsible for investigation, defence, settlement, and discharge of such claims.
7. Legal Compliance
You represent and warrant that:
- You are not located in a country subject to Australian or U.S. government embargoes
- You are not listed on any prohibited or restricted party list
- You will comply with all applicable laws and regulations
8. Payments & Subscriptions
Where applicable, payments and subscriptions are processed securely through Apple In-App Purchases and/or Stripe, subject to their respective terms and policies.
Wellbeing Passport does not store full payment details.
9. Privacy
Your use of the Application is subject to our Privacy Policy, available at:

10. Termination
This Agreement remains effective until terminated.
It will terminate automatically if you fail to comply with any term.
Upon termination, you must stop using the Application and delete it from your devices.
11. Third-Party Beneficiary
Apple and its subsidiaries are third-party beneficiaries of this Agreement.
Upon your acceptance, Apple has the right to enforce this Agreement against you.
12. Governing Law
This Agreement is governed by the laws of New South Wales, Australia, without regard to conflict of law principles.
